Terms & Conditions

1) Agreement to Terms

These Terms govern your access to and use of WishPop at https://wishpop.co (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2) Eligibility & Accounts

You must be at least 13 years old (or the age of digital consent where you live). You are responsible for the accuracy of your information and for maintaining the security of your account and devices.

3) Premium Subscription

  • Price: $4.99/month (subject to change with notice).
  • Auto‑renewal: Premium renews anytime, effective end of period. You can manage/cancel in your account settings.
  • Refunds: First‑time Premium purchases are eligible for a one‑time refund request within 7 days of purchase unless prohibited by law. Renewals are generally non‑refundable.
  • Changes: Features and prices may change. We’ll notify you of material changes before they take effect.

4) Premium Features

  • Video Reactions: invitees can upload short videos to your WishPop.
  • Smart WishPops: duplicate‑prevention via Reserve/Claim/Purchased indicators.
  • Branded Links: custom share URLs and QR codes.
  • Premium Templates: exclusive themes and effects.

5) User Content & License

You retain ownership of content you upload (e.g., videos, images, text). You grant WishPop a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, and display your content solely to operate and improve the Service (including backups and content delivery). You represent you have all rights and permissions, including permissions from individuals appearing in any videos.

6) Video Reactions — Community & Moderation

  • Hosts may hide or remove reactions on their lists.
  • Do not upload content that is illegal, harassing, hateful, pornographic, or infringes rights.
  • We may remove or disable access to content alleged to be unlawful or infringing and may suspend accounts for repeat or egregious violations.

7) Smart WishPops — Disclaimers

Smart WishPops shows reservation and self‑reported purchase status to reduce duplicates.WishPop does not guarantee that a reserved or claimed item was purchased, nor the availability, pricing, delivery, or quality of third‑party products.

8) Premium Templates — License

Premium Templates are licensed for use solely within the Service to style your WishPop pages. You may not extract, resell, or redistribute template assets outside the Service. WishPop may modify or retire templates; applied templates remain in effect on existing WishPops via saved snapshots.

9) Branded Links

Branded slugs are available to Premium users while subscriptions remain active. We may revoke or reassign slugs that violate trademarks, are abusive, or conflict with system routes. If you rename a slug, we may provide client‑side redirects from your prior slugs for a reasonable period.

10) Affiliate Disclosure & Third‑Party Links

Some product links are affiliate links. If you click and buy, WishPop may earn a commission at no extra cost to you. We are not responsible for third‑party sites or their policies; your use of third‑party services is at your own risk and subject to their terms.

11) Acceptable Use

  • No illegal, infringing, deceptive, or abusive activity.
  • No attempts to bypass security, spam users, or scrape without consent.
  • No uploading malware or content containing others’ personal data without permission.

12) Intellectual Property

The Service (including software, designs, and templates) is owned by WishPop or its licensors and is protected by law. Except as permitted herein, you may not copy, modify, or create derivative works of the Service.

13) DMCA / IP Complaints

If you believe content infringes your rights, email support@wishpop.co with: your contact info, a description of the work, the allegedly infringing material’s URL, a statement under penalty of perjury that you are authorized to act, and your signature.

14) Disclaimers

THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WishPop DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WishPop AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID IN THE 12 MONTHS BEFORE THE EVENT OR (B) USD $50.

16) Indemnification

You agree to defend, indemnify, and hold harmless WishPop and its affiliates from claims arising from your content, your use of the Service, or your violation of these Terms or applicable law.

17) Governing Law & Venue

These Terms are governed by the laws of State of New York, USA, excluding conflicts rules. Courts there have exclusive jurisdiction unless mandatory law provides otherwise.

18) Changes

We may update these Terms. We’ll post the updated version with the effective date. Continued use after changes constitutes acceptance.
